Mexican Nationals on Death Row in the US

On 5 February, 2004, the International Court of Justice (ICJ) in The Hague ruled that three of the Mexican nationals on death row in the United States should be granted a temporary stay of execution. In a unanimous decision, in Avena and Other Mexican Nationals (Mexico v. United States of America), the ICJ said the delay was necessary so that it may conduct an investigation into whether the prisoners were given their right to legal help from the Mexican government. The US was held by 14 votes to 1 to be in breach of its obligations under the Vienna Convention on Consular Relations. Mexico claimed that all 51 of its citizens on death row in the US should be retried as they were denied assistance from Mexican consular officials. The US Government has not yet declared whether it will abide by the ruling handed down by the ICJ.
